A paternity judgment required the father to pay child support. After the Judgment occurred, the father moved in with the mother and children in an attempt to reconcile. During the attempted reconciliation, the father did not pay child support to the mother. The reconciliation failed and the parties disputed the father’s child support arrears(back support). The father filed a Motion seeking a determination of child support arrearages. The Orange County Trial Court denied the father credit for the reconciliation time and he appealed. The Appellate Court held that father was potentially eligible for credits against his child support obligation provided he was able to prove actual in-kind or in-the-home support.
